AG Obtains Restraining Order Against Legend Windows, LLC for Deceptive Practices and Consumer Protection Violations

State authorities seeking more victims of alleged scam by Alabama window business

In a bid to protect consumers from fraudulent business practices, Alabama Attorney General Steve Marshall has obtained a restraining order against Legend Windows, LLC. The order, granted by the Circuit Court of Shelby County, prohibits the business and its associates from operating while the case is under review.

The complaint filed by the state accuses Legend Windows of deceiving customers into paying deposits for new windows and doors without delivering the promised products. The company allegedly violated the Alabama Deceptive Trade Practices Act multiple times, with over 40 known victims across the state who are collectively owed more than $181,000 in damages.

Furthermore, Jody Whitworth was accused of misusing customer payments for personal expenditures instead of fulfilling the promises made by the business. An investigation revealed that between September 2022 and March 2024, Legend Windows used its bank account to make over 1,100 purchases from Amazon totaling approximately $50,000. Additionally, the business made purchases from numerous other retailers amounting to over $20,000.

The attorney general’s office believes there may be more victims statewide and has created an online survey for individuals with unresolved claims to report their experiences. Those affected can visit the attorney general’s website to provide information about their situation and seek redress for any losses incurred. The efforts to address fraudulent activities of Legend Windows and its affiliates are part of the state’s commitment to protecting consumers from deceptive business practices and holding perpetrators accountable for their actions.

In a news release, Marshall expressed his determination to hold Legend Windows and its associates accountable for their fraudulent activities. He stated that they have victimized many consumers over an extended period.

The restraining order granted by Circuit Court of Shelby County will remain in effect until further notice or until such time as it is lifted or modified by court order.
