In 2021, millions of sleep apnea devices were recalled by Philips due to loose insulating foam causing serious injuries. This led to significant financial losses for the company in terms of recalls, lost profits, and legal fees. Despite initial skepticism, an international group of lawyers has now launched a class action lawsuit on a European scale, the first of its kind. The lawsuit seeks compensation for patients who have experienced emotional distress, respiratory problems, or other health issues as a result of using the device.
The sleep apnea device was intended to give patients a better night’s sleep by reducing snoring and improving breathing patterns. However, the device has caused numerous issues for Philips itself. An Italian law firm has initiated the European class action lawsuit on behalf of the Italian consumer organization Adusbef, which applies to the entire European Union. The lawsuit aims to hold Philips accountable for its delayed response to the issue, which has been known since 2008.
Despite denying any wrongdoing so far, more European patients may join the class action following the verdict. The share price actually increased after the US settlement earlier this year. The lawyer Stefano Bertone stated that this delay is unacceptable and that Philips should be held responsible for their actions. This class action lawsuit is set to bring justice to those who have suffered from using these faulty devices and hold Philips accountable for their negligence.
