Vice President Kamala Harris Faces Possible 25th Amendment Activation in Response to Biden’s Performance in First US Presidential Debate

Following President Joe Biden’s performance in the first US presidential debate with Donald Trump, the New York Times editorial board has called on him to withdraw from the upcoming presidential race. The board cited concerns over his health and ability to meet the demands of another term, stating that he failed to reassure Americans of his plans for a second term and struggled to counter Trump’s provocations. Despite this call, the board expressed its intention to support Biden if he ultimately faces off against Trump in November 2024.

In the lead-up to the presidential election, Biden and Trump faced off in their first live debate on CNN. While Biden’s performance did little to alleviate concerns about his age and fitness for a second term, it also drew heavy criticism from many viewers. In response, Republican representative Chip Roy filed a resolution calling on Vice President Kamala Harris to convene the Cabinet and invoke powers under the 25th Amendment as acting president. The resolution argued that Biden has repeatedly demonstrated an inability to discharge his duties as president, including those of commander-in-chief. If passed by Congress, such an action would effectively remove Biden from office and make Harris the acting president.

The 25th Amendment gives Congress certain powers regarding the presidency in cases where a president is unable or unwilling to perform their duties. Under this amendment, a majority of cabinet members can vote with the vice president to declare a president “unable to discharge powers and duties” and assume these duties themselves. However, such actions are rare and typically only taken when a president is incapacitated or unable due to illness or other reasons beyond their control. As such, it remains unclear whether this resolution will be successful or if it will ultimately lead to any significant changes in government leadership before November 2024.
